License Agreement and Terms of Use

Fakturino application

Business version (B2B mode)

1. Introductory Provisions

1.1. These Terms govern the legal relationship between the operator of the Fakturino application (hereinafter referred to as the "Provider") and the user of the application (hereinafter referred to as the "User").

1.2. The Application is intended exclusively for entrepreneurs within the meaning of Section 420 of the Czech Civil Code.

1.3. By using the Application, the User expressly declares that he is acting as part of his business activity and not as a consumer.

1.4. The provisions on consumer protection do not apply to the legal relationship between the Provider and the User.

1.5. This End User License Agreement (EULA) is between the user of Fakturino and the operator of the application (Provider), not Apple Inc.

1.6. Apple is not a party to this Agreement and has no responsibility for the Application or its content.

2. Nature of the Application

2.1. The Application is a software tool for creating and keeping records of invoices.

2.2. The application does not constitute accounting, tax or legal advice.

2.3. The Provider does not guarantee that the outputs of the Application comply with current legislation or suit the User’s individual circumstances.

3. License

3.1. The Provider grants the User a non-exclusive, non-transferable license to use the Application within the scope of the selected plan.

3.2. The license is provided exclusively for the User's business purposes.

3.3. The User may not:

  • edit
  • to reverse engineer (reverse engineering),
  • provide to third parties,
  • use commercially other than for your own business.

4. Data Responsibility

4.1. The User bears full responsibility for all data entered into the Application.

4.2. The Provider is not liable for:

  • data loss,
  • data corruption,
  • incorrect data,
  • sync failures,
  • errors caused by third-party services (iCloud, CloudKit, App Store, etc.).

4.3. The User must arrange their own checks and any necessary data backups.

5. Legal and Accounting Responsibility

5.1. The User is responsible for ensuring that all invoices and other documents they issue meet all legal requirements.

5.2. In particular, the user is responsible for:

  • correct application of VAT,
  • accuracy of identification data,
  • listing all mandatory document requirements,
  • correct accounting of documents,
  • compliance with tax, accounting and business regulations.

5.3. The Provider is not liable for:

  • sanctions, fines or tax assessments,
  • administrative or judicial proceedings,
  • financial losses arising from improper use of the Application,
  • errors resulting from legislative changes.

5.4. Before using or sending any document, the User must verify its accuracy and compliance with applicable law.

6. Limitation of Liability

6.1. The Application is provided "as is".

6.2. The Provider is not liable for any indirect or consequential loss or damage, including:

  • lost profit,
  • loss of business opportunity,
  • business interruption,
  • reputational damage.

6.3. The total liability of the Provider for any damage is limited to the amount paid by the User for the use of the Application in the last 12 months.

6.4. The Provider is not liable for damage caused by:

  • improper use of the Application,
  • incorrect data entry by the User,
  • breach of these Terms,
  • interventions by third parties.

7. Technical errors

7.1. The User acknowledges that software may contain errors.

7.2. The Provider does not warrant error-free or uninterrupted operation.

8. Governing Law

8.1. These Terms are governed by the laws of the Czech Republic.

8.2. The parties agree that all disputes arising from these Terms shall be heard by the court with subject-matter jurisdiction for the Provider’s registered office.
